General terms and conditions of use
Version 2.1 of 19 February 2020
The general terms and conditions of use (“GTC”), subject to French law, are intended to govern the use of features and services (“Services”) accessible on the site: manpower.fr (“Site”) or the mobile application My ManpowerTM (available for download at the official portals of mobile operating system publishers, “Application”) published by the company Manpower France (“Manpower”).
Any use of the Services shall be deemed to occur in France.
For the purposes hereof, the expressions “you”, “your” and “User” mean any user of the Services, registered or non-registered, consulting, having tried to consult or having consulted any element, of any kind, an html page, java applets or others, and/or accessing, having tried to access or having accessed any Service, whatever the code and/or the technology used and accessible through the Site.
By using the Services or installing the Application, you agree to comply with these GTC. Please read these terms carefully before use and/or acceptance. Where applicable, certain Services may be subject to additional specific terms. If you choose to use these Services, you agree to be contractually bound and to comply with these additional terms.
Article 1. TERMS & CONDITIONS
The Services are published by Manpower France, a Simplified Joint Stock Company with a capital of 50,000,000 euros, whose head office is located at 13 rue Ernest Renan, 92723 Nanterre Cedex, registered in the Nanterre Trade and Companies Register under number 429 955 297. Manpower France is a temporary employment company, and our financial guarantor (Art. L. 1251-49 of the Labour Code) is BNP PARIBAS – 37-39 rue d’Anjou – 75008 Paris.

Where applicable, certain accessible Services are hosted by third party partners, and the contact details of these hosts are available to all Users. Manpower indicates the special features of these Services in the corresponding pages and/or frames.
Article 2. ACCESS TO SERVICES
To use the Services, you may be required to correctly complete all of the fields indicated for this purpose by Manpower. Manpower reserves the right to delete any file with incomplete or incorrect information.
By using the Services, you guarantee that you will not upload, fill in or publish in any way information that is offensive, illegal or likely to infringe the rights, harm or threaten the safety of any person. You are solely responsible for the information and content that you communicate to Manpower through the Services and you guarantee the truthfulness of this information and content, which you will ensure is kept up to date.
To use all of the Services, you acknowledge that you have the equipment and connection needed to access the Internet or mobile telecommunications networks if necessary; it is your responsibility to keep up to date all the software needed for your equipment to run smoothly. You are informed and acknowledge that the terms of your contracts with third parties, in particular access providers or mobile operators, continue to apply when you access our Services. It is therefore possible that these third parties will bill you for connections (voice or data, incoming or outgoing) for the duration of your use of the Services. The corresponding fees are your sole responsibility. If you use third party equipment to access our services, you guarantee that you have the consent of this third party.
Manpower strives to standardise the management of its interfaces. However, certain Services or Service features are only accessible via one of these interfaces: Site or Application. Likewise, for reasons of accessibility or usage preferences, you may choose to consult certain Services on one of these interfaces for accessing the Services.
2.1 Online recruitment service
This Service is intended for companies and legal persons and allows you to directly use Manpower for the following services:
recruitment of employees, particularly for short- and long-term contracts, long-term temporary employment contracts, temporary employment or work-study programmes

2.2 Online application service/My Manpower Candidate
Access to this Service is exclusively reserved for Registered Users. It is for adults only; minors must go to one of our agencies before they can use our Services. Your registration for this Service is confirmed by e-mail at the e-mail address given when you registered.
You hereby certify on your honour that the information that you bring to Manpower’s knowledge is accurate, you do not have any commitments and are not in a situation which does not allow salaried employment (paid leave, maternity leave, sick leave, etc.). In the event that your situation changes, you hereby agree to inform Manpower.
To access this Service, you must have a valid e-mail address.
Once you have created your My Manpower account, you can:

upload your CV

update your profile (contact information, availability, etc.)

create e-mail alerts based on criteria that applies to you

apply online for jobs
-
track the status of your applications in real time

update your personal data and configure your terms of use for the Services and your personal data
In order to protect your personal data and keep only up to date information, if your registration does not lead to a job and/or recruitment with one of our customers, your My Manpower Candidate account will be deleted 13 months after your last login. One month before the deadline, a message from Manpower will alert you of its upcoming deletion. If you wish, you can reactivate it for 13 months by simply logging in using your e-mail address and password.
To meet specific selection needs for its customers, Manpower may send them the relevant documents or information that you gave us, which you hereby accept.
As such, Manpower may send your CV, which you uploaded when you created your account, including contact details and photographs. If you do not wish your contact details and photographs to be sent to our customers, we invite you to upload a CV without photographs or contact details to the “My CVs” tab and name it “Anonymous”.
2.3 My Manpower Temp Service
Access to “My Manpower Temp” Service is exclusively reserved for Registered Users.
To access this service, you must have a valid e-mail address.
My Manpower Temp allows you to:

upload your CV

update your profile (contact information, availability, etc.)

create up to 5 e-mail alerts based on criteria that applies to you
-
apply online for jobs
-
track the status of your applications in real time
-
update your personal data and configure your terms of use for the Services and your personal data
My Manpower Temp also allows you to manage your temporary employment:

update your personal data and configure your terms of use for the services

update your availability, add vacation
-
obtain information on your current and upcoming jobs

organise your trips with the goal of taking a job
-
consult your activity statements and job history
-
download duplicates of your most recent pay slips
-
discover the advantages from your seniority
-
find all practical information to better understand your status
-
contact your agency online
-
contact your online payroll department
-
make advance payment requests
-
simplify your procedures with Pôle emploi (employment centre)
-
facilitate your housing requests with our partners (subject to eligibility)
-
manage your Time Savings Account (established by Company Agreement of 3 September 2015; the eligibility conditions, the minimum investment amount, the conditions for receiving interest and the interest rate amount are specified here)
When you are sent on a temporary work assignment, you agree to sign and return to your Manpower agency the job contract which will have been sent to you; if you have chosen to receive it in dematerialized format, once it has been electronically signed, it is automatically sent to Manpower.
All temporary Manpower employees who have completed at least 1 hour of work in the last 24 months can benefit from a My Manpower Temp account.
Manpower agencies can also make a My Manpower Temp account for you before a job.
Each My Manpower Temp account can be activated before the first login using one of the two following procedures:

For temporary workers who have completed a temporary work assignment with Manpower completed less than two (2) months ago, the account can be activated online, from the My Manpower page, by selecting “Temporary” from the “Your Profile” drop-down menu, then entering the e-mail address and password of your choice. You must then enter your temporary employment number and the number of your last job that appears on your pay slip.

For temporary workers who have not completed a temporary work assignment with Manpower in the past two (2) months, your account must be activated at your local Manpower agency.
A User’s My Manpower Temp account will remain active at least twenty-four (24) months after the last payment was received and/or as long as the User maintains a candidate account.
2.4 Dematerialization services
Dematerialization services are optional, free and exclusively reserved for Registered Users who are temporary employees of Manpower and who have a My Manpower account.
Dematerialization services allow temporary employees to activate a digital safe (hereinafter, “Digital Safe”) in order to:

receive pay slips in electronic format,
-
receive electronic documents from Manpower (including signed employment contracts),
-
and store electronic personal documents.
The Digital Safe, accessible at
www.manpower.novapost.fr, is a remote access storage space. This Digital Safe is provided by a third-party company: Peopledoc, Simplified Joint Stock Company whose registered office is located at 32 rue de Paradis, 75010 Paris, registered in the Paris Trade and Companies Register under number 499 898 047. Following the activation of the services, the User will receive an e-mail for the provision of the Digital Safe service and the creation of its login credentials. The Digital Safe Service is subject to General Terms of Activation and Use published by Peopledoc. Manpower is not in any way responsible for the availability of the Digital Safe or the level of service offered by Peopledoc. Once the subscription to the Digital Safe has been confirmed, the User is directly linked to Peopledoc and may continue to use the Digital Safe, according to the terms published by Peopledoc, including after termination of a relationship with Manpower.
By activating the dematerialization services, the User, a temporary employee of Manpower, expressly agrees to receive its pay slips from Manpower in electronic format, as provided for in Article L. 3243-2 of the Labour Code.
Temporary Manpower employees can at any time, from their My Manpower Temp account, activate or deactivate their subscription to dematerialization services. It is taken into account within the best delays.
Manpower reserves the right, at any time, to suspend or stop all or part of the Dematerialization Services. Manpower will inform the Users within the best delays, and if necessary, send the documents provided in paper format to the contact details listed by the User in its My Manpower account.
2.5 Manpower Training Service
Access to the “Manpower Training” Service is exclusively reserved for Registered Users who are candidates or temporary employees of Manpower and who have a My Manpower account.
Manpower offers its temporary employees the opportunity to maintain and/or develop their professional skills by accessing evaluation, knowledge improvement and training modules called E-Learning modules, accessible online via the My Manpower personal profile on the Site.
These E-Learning modules are available on the Manpower Training platform (“the Platform”) published by Manpower, hosted on a third party site of the Site.
The Platform is hosted by Futurskill Digital (Syfadis), a Simplified Joint-Stock Company with a Sole Shareholder with a capital of €65,426.00 whose head office is located at 31 rue Guy Ropartz, 35700 Rennes, registered in the Rennes Trade and Companies Register under number 437 663 180. Access to the catalogue of “courses open to all” is free, unpaid and freely accessible for a one-year period, starting the date of registration on the Platform. This period is automatically renewed for successive one-year periods, provided that the User is still registered and active with Manpower.
Access to the other courses in the catalogue is subject to terms and authorised subject to pre-registration.
As part of the Blended-Learning course (mixed courses: face-to-face and distance) and Open Distance Training, certain E-Learning modules may be subject to specific access terms and conditions. These are described prior to each module in an individual training protocol, which each person concerned must approve before registration.
All modules offered do not fall under the Manpower training plan and cannot systematically be the subject of a paid training contract.
Manpower reserves the right to modify the terms of access to these two catalogues at any time.

Article 3. PROTECTED RIGHTS
All the content presented in the Services, in particular, and not limited to: architecture, texts, training content, photographs, illustrations, applications, etc. is the property of Manpower, its technical service providers, or their rights holders.
When you access the Services, Manpower grants you, for the duration of your access, representation and reproduction rights to this content on the equipment and browsers used to access the Services. These rights are granted on a revocable, personal, non-transferrable and non-exclusive basis. All other rights are expressly reserved to Manpower or the rights holders.
In accordance with Article L. 122-4 of the Intellectual Property Code, any representation, reproduction, extraction, or use not expressly authorised by Manpower, in whole or in part, free of charge or for a fee, and by any process whatsoever, of an element — at least — of the Site, is illegal and constitutes an infringement punishable in particular by articles L. 335-2 et seq. of the Intellectual Property Code.
“Manpower®”, “ManpowerGroup®” and the various logos and names published in the Services are registered or protected in accordance with the provisions of the Intellectual Property Code. Their reproduction, without the prior written consent of their rights holder, is also considered infringement.
You hereby agree not to modify, destroy, conceal or otherwise remove any notice or identification of copyright or property contained in the Services and these GTC.
You must not, or must not let third parties on your behalf, (i) make or distribute copies of the Services, (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Services; or (iii) create derivative works of the Services of any kind. You are not authorised to copy any part of the Services or use for a commercial purpose, rent, offer to rent, lend, sell, publish, offer under license or sub-license, distribute, assign or otherwise transfer any part of the Services to any third party.
Article 4. BROWSING
Before connecting to the Services, it is your responsibility to ensure that your equipment allows you access to the Service, if necessary, in a secure configuration. Similarly, before any use of the Services, it is your responsibility to ensure that the cache memory of your equipment or browser has been emptied, in order to ensure, where applicable, that the accessible pages or content are up to date. Manpower reserves the right to improve, modify or withdraw all or part of the features or Services, at any time and for any reason whatsoever. You may download and install any update to the Services, in particular for the Application.
4.1 Login and usage data
When you access the Services, Manpower may automatically obtain certain data concerning you (in particular technical data relating to the use of the Services, such as the Internet Protocol (IP) address of your equipment, your type of connection, your Internet service provider’s IP address, date and time of Service access, the Internet address of the website from which you are redirected to the Services, the operating system you use, the pages you access, the number of features activated in the Services, your type of equipment, the version number of our Services that you use) as well as the information that you post or upload to the Services. This data can be used for the administration, improvement and securing of our Services.
You are hereby informed that using certain Services features (especially in the Application) may require the use of geolocation data, in particular the geographical position of your mobile equipment, which you hereby accept if you would like to use these features.
4.2 Cookies
You are hereby informed that when accessing and using the Services (especially the Site), information is temporarily stored in their memory or hard drive, in particular through cookies or other technology.
These cookies are used to meet the following needs:

You hereby acknowledge having been informed of this practice and authorise Manpower to use it.
You may nevertheless and at any time object to the saving of these “cookies” by using the privacy and/or security options of your browser (such as: Firefox, Opera, Explorer, Chrome etc.); objection to all cookies might restrict access to all or part of the Services features.
4.3 Hyperlinks and Third Party Services
Manpower may offer or present on the Site or Application links or interfaces to third party sites, applications or services. These presentations are established in agreement with the third parties concerned at a time when Manpower deemed it appropriate to do so, taking into account the content and services offered by these third parties.
The existence of a link or redirection to another site or a third party service is not considered a recommendation or approval of this site, its content or the services offered.
Such sites or services are independent of the Services. Manpower does not publish or control the sources or content of these sites or their links with other sites.
The existence of a link or redirection to another site or third party service does not in any way constitute approval, validation or acceptance of Manpower to the content of these sites or the services offered nor an association of Manpower with the owners and/or authors, publishers, designers, animators, managers or hosts of these sites or services. It is your responsibility to use these information and presentations with discretion, think critically and inform yourself about the terms of use or marketing of these third party sites, content or services.
Manpower cannot therefore be held liable for the content, products, services, advertising, cookies or any other element of these sites or services, as well as any proven or alleged damage or loss, immediately following or related to the use of information, opinions, services or data available on these sites or services.
Article 5. LIABILITY
Manpower, its managers and/or employees cannot be held liable for any damage whatsoever arising from connection to and/or use of the Site and/or any Service.
5.1 Login information confidentiality and access codes
Manpower, its managers and/or employees cannot be held liable for any damage whatsoever arising from connection to and/or use of the Site and/or any Service.
Manpower may grant you, for the use of certain Services, login information and access codes required to connect to the Service (“Login information”). This login information is strictly individual, non-transferable, confidential and your responsibility. Be careful not to send this Login information to third parties in order to keep confidential the professional and personal data that you sent us, as well as the information accessible by this Service.
Any access to a Service, its use and any operation through it, carried out using your Login information, will be considered to have been carried out by you. Consequently, you hereby agree not to transfer or send your Login information to a third party. You remain solely responsible for its use and hereby agree to take all necessary measures to ensure it stays confidential.
In the event that Manpower would have any reason to believe in an abusive or noncompliant use of Login information and, more generally, for the purposes of ensuring the security of the Services, Manpower reserves the right, at any time, without prior notice or formality and without this granting the right to compensation for any damage, in particular loss of profit, activity or opportunity, to suspend and/or delete any Login information and all access to the Site. Manpower reserves the right to inform you nevertheless and by any means of the aftermath of such measures.
Notwithstanding the foregoing, you agree to (i) inform Manpower without delay of any unauthorised use or knowledge by a third party of your Login information, circumstances having led to such use or knowledge and (ii) actively cooperate with Manpower to end this unauthorised use or knowledge.
Manpower cannot be held liable for the use of the Service by a third party in possession of your Login information.
5.2 Content of the Services
The information and data made available on the Site are provided for informational purposes only and in no way constitute legal and/or business advice nor incur the liability of Manpower.
In this context, the Services can allow you to access, in particular, information and data relating to human resources news, economic news, ManpowerGroup, assignment postings and job offers, temporary work regulations and, more broadly, labour law.
In no way does Manpower guarantee that the disseminated information is accessible, relevant, up to date or exhaustive, nor can it be held liable for this information, suggestions or content, or for decisions made on the basis or influence of such content or the unavailability of the Site, especially during the maintenance period.
In particular, the information given under the “Leaving on Assignment” screens is not considered an employment contract or a promise of an employment contract. For any clarification or validation, please contact your local agency.
We remind you of the risks inherent in electronic transmission of information. Delays, omissions or inaccuracies are likely to occur. The information accessible via the Services is provided in its current state, whatever its source.
5.3 Communication privacy via the Internet and other networks
Given that communications via the Internet and other telecommunications networks (in particular for access through any mobile connectivity equipment) are, by default, not secure, Manpower cannot be held responsible for any voluntary or involuntary interception by a third party of any message and/or information exchanged between Manpower and you.
5.4 Availability
The Services are in principle accessible 24 hours a day, 7 days a week, except in the event of planned and unplanned interruptions, for maintenance, updates or in case of force majeure. Being subject to an obligation of means, Manpower cannot be held liable for any damage of any kind resulting from unavailable Services.
5.5 Evidence, storage and archiving
In accordance with Article 1316-2 of the Civil Code, Manpower and you intend to establish together, within the framework of the Services, rules for admissible evidence in the event of a dispute and their probative value. The following provisions thus constitute the evidence agreement established by you and Manpower.
The digital registers, kept in the Manpower systems in compliance with best security practices, will be considered proof of e-mail communication, registration form submission, document uploads, acceptances, subscriptions to services and orders. Archiving this information and documents is carried out on a medium that ensures the accuracy and lasting nature required by the legal provisions in force. It is agreed that in the event of a discrepancy between our digital registers and any of your documents in any format (paper, electronic or other), Manpower’s digital registers will prevail.
Article 6. PERSONAL DATA
You are hereby informed and accept that Manpower processes personal data concerning you in accordance with the following provisions. You are reminded that certain uses of your data can be configured directly from your personal account. Your configuration changes will be taken into account within the best delays.
6.1 Specific provisions – Candidates and temporary workers (version 2.3 of 17 February 2020)
Manpower collects and processes your personal data in order to satisfy the following purposes:
* Due to the nature of the relationship between you and Manpower (candidates or temporary worker) and its evolution, the legal basis defined in the table are given for information purposes.
In the event that the processing is based on your consent, you are hereby reminded that your consent can be withdrawn at any time.
Certain collected data are required for accessing Manpower services. You have the option of configuring, via your personal account accessible from
www.manpower.fr/mon-manpower, the processing methods for your data.
Furthermore, Manpower may publish, disclose and use aggregated information (information relating to all users or specific groups or categories of users combined in order to avoid the identification or reference of an individual) and non-personal information for the purposes of analysis of the sector and market, demographic profiling, promotional and advertising purposes or for other commercial purposes.
No decision that has legal effect on you will be based solely on automated decision-making.
If you choose to not provide certain required personal data, Manpower may not be in capacity to provide with the services requested by you or fulfil the purposes for which Manpower processes the personal data.
The data concerning you will be kept for the time needed to accomplish the aforementioned purposes. It is hereby brought to your attention that the general principles of data retention are:

the candidate’s data will be kept for a maximum period of 24 months from the last contact,

the data of temporary employees will be kept for a maximum period of 5 years, starting with the last payment (excluding career summary data).
Certain specific data processing implemented by Manpower may have different retention periods. If you wish to obtain more details on the storage rules for a specific processing, you may contact the Data Protection Department and/or Manpower’s Data Protection Officer, by the means of your choice between:

Manpower may send, for the purposes of the aforementioned objectives, the information concerning you to other ManpowerGroup entities (parent company and its subsidiaries), customers and subcontractors who provide services at their request; some of these companies may be located outside the European Union and outside countries recognised by the European Union as having laws guaranteeing adequate protection of personal data. In accordance with the regulations in force, Manpower has taken the necessary measures to ensure that the personal information thus transferred is protected in terms of their security, integrity and confidentiality. Any data transfers shall be carried out in accordance with regulations and must comply with the standard contractual clauses established by the European Commission. If necessary, Manpower will provide you with the appropriate specific information, in accordance with the regulations in force.
As part of using means of communication (electronic mail) and office or collaborative tools, information about you may be hosted in the United States of America. As part of our recovery procedures with our customers, Manpower may use subcontractors located in Tunisia. As part of IT support services, data may be made accessible from Morocco.
In addition, information concerning you may be communicated to any person or public or private entity, in particular administrative bodies or professional associations, when this communication is provided for by law or regulations.
In the event that Manpower would be involved in a merger, acquisition, transfer of assets or bankruptcy proceedings, Manpower may be required to assign or share all or part of its assets, including personal data.
In accordance with the regulations, you may exercise your rights of rectification, objection, deletion, restriction of processing and portability, under the terms of applicable regulations, for the personal data that Manpower holds, by sending a request mentioning your surname, first name, address, temporary employee number, name of your Manpower agency and attaching a copy of proof of identity.
You may also send to the Data Protection Department your instructions for the outcome of your personal data in the event of death, and, in particular, the manner in which you wish the aforementioned rights to be exercised.
Generally, the Data Protection Officer and the Data Protection Department remain at your disposal for any further information or claim related to the processing of your personal data carried out by Manpower.
Manpower will answer your request within the best delays, in accordance with the term defined by the applicable regulation.
Manpower reserves the right to modify, at any time, this Information Policy on its personal data processing policy. The effective date of this policy can be found at the beginning of the text. Please refer to it periodically, and in particular whenever you provide us with personal information.
It is brought to your attention that the supervisory authority in France for data processing is the National Commission for Information Technology and Civil Liberties,
www.cnil.fr, from which you can request any information or file claims.
6.2 Specific provisions – Clients and Prospects (Version 2.0 of 17 February 2020)
Manpower collects and processes personal data relating to its Clients and Prospects’ contact persons and/or their representatives and agents in order to satisfy the following purposes:

In the event that the processing is based on your consent, you are hereby reminded that your consent can be withdrawn at any time.
The sources of the data processed by Manpower are the data that you give us and data generated by Manpower in the course of our activities with you.
Furthermore, Manpower may publish, disclose and use aggregated information (information relating to all users or specific groups or categories of users combined in order to avoid the identification or reference of an individual) and non-personal information for the purposes of analysis of the sector and market, demographic profiling, promotional and advertising purposes or for other commercial purposes.
No decision that has legal effect on you will be based solely on automated decision-making.
If you choose to not provide certain required personal data, Manpower may not be in capacity to provide with the services requested by you or fulfil the purposes for which Manpower processes the personal data.
The data concerning you will be kept for the time needed to accomplish the aforementioned purposes. It is hereby brought to your attention that the general principles of data retention are:

the data relating to the Customer and Prospective Customer contacts are kept for a maximum period of 5 years, starting with the end of the business relationship.

Some of these companies are located outside the European Union and outside countries recognised by the European Union as having laws guaranteeing adequate protection of personal data. In accordance with the regulations in force, Manpower has taken the necessary measures to ensure that the personal information thus transferred is protected in terms of their security, integrity and confidentiality. Any data transfers shall be carried out in accordance with current regulations and must comply with the standard contractual clauses established by the European Commission. If necessary, Manpower will provide you with the appropriate specific information, in accordance with the regulations in force.
As part of using means of communication (electronic mail) and office or collaborative tools, information about you may be hosted in the United States of America. Our customers are informed that, as part of our recovery procedures, Manpower may use subcontractors located in Tunisia. In order to ensure high-quality service, telephone conversations made or received in this context may be recorded. As part of IT support services, data may be made accessible from Morocco.

Article 8. ACCEPTANCE AND MODIFICATION OF THE GTC AND POLICIES
Notwithstanding any formal acceptance on your part, your access to or use of the Services (whether you are a registered or unregistered User), as an individual or professional, implies your explicit and unconditional acceptance of the GTC, including stipulations of any policy (“Policies”) relating to the management of personal data.
If you access or use the Services in a professional capacity, you guarantee to Manpower that you have all the rights, permissions and authority needed to accept these GTC on behalf of the company, organisation, partner or any other entity (“Entity”) for which you use or access the Services and/or create an account according to the specified terms when accessing the Services.
